Counsel: prosecutors overzealous in Stevens case

A special counsel says prosecutors were so intent on winning a corruption case against the late Sen. Ted Stevens that they intentionally withheld information they were obligated to give the defense.

Henry Schuelke III has told the Senate Judiciary Committee that absence of supervision by high Justice Department officials played a key role in the botched case. A furious federal judge in April 2009 dismissed the Alaska Republican's conviction from the previous year.

The judge appointed Schuelke, a private attorney and former prosecutor, to investigate misconduct by prosecutors.

Schuelke said prosecutors failed to give the FBI time to review material that should have been given to Stevens' attorneys.

It took an FBI whistleblower to inform U.S. District Judge Emmet Sullivan of the misconduct. Attorney General Eric Holder requested dismissal.
