DWI charges against former FAA chief dismissed

A Virginia judge has tossed out drunken driving charges against the former head of the Federal Aviation Administration.

Randy Babbitt, 65, resigned his post in December after news of his arrest became public.

At a trial Thursday, General District Judge Ian O'Flaherty tossed the case after seeing video of the left turn that Babbitt made that prompted an officer to pull him over. The judge said the officer had no good reason to make the stop and called it a mere "hunch."

In an opening statement, defense attorney Peter Greenspun said the first breath test given to Babbitt came in under the .08 legal limit. Evidence of the breath test was not presented because the judge ruled that the tests should not have been administered.
