The president of the New England Compounding Center, which is linked to the fatal meningitis outbreak, is expected to invoke his Fifth Amendment rights Wednesday during a Capitol Hill hearing.
The president, Barry Cadden, has been subpoenaed to testify by the Republican-led House Energy and Commerce Committee.
It was unclear Wednesday morning whether he will attend the hearing.
The hearing, "The Fungal Meningitis Outbreak: Could It Have Been Prevented?," will examine the facts surrounding the outbreak, which has been linked to contaminated steroid shots distributed by the now-shutdown Massachusetts-based company.
Thirty two people have died and more than 400 people have been infected in the outbreak.
Food and Drug Administration Commissioner Margaret Hamburg is scheduled to testify next week before the committee.
